This policy applies from 25 March 2024, onwards and our Cancellation Policy is governed by Spanish law.

Something we all learned in the last few years is that no matter how well-organised you are, there is always the chance something annoying may get in the way of your travel plans. 

We absolutely understand this

Therefore, we have chosen a policy that offers our customers flexibility and peace of mind while also being fair to our local guides and services. 

Many of the large travel companies offer free cancellation even a few weeks before the tour start date, while this is great for clients, it is extremely challenging for small companies like Camino Confidence . When you book a tour, we block off the calendar as do our guides and other services and turn down requests from other travelers. Regardless of how many there are in the group, Camino Confidence is contracted to pay the guides the same amount, in addition, nowadays, many of the accommodations are asking to be paid up front and they have their own cancellation policies they we have to abide by.

Last-minute cancellations leave them without income. This leaves local experts in a precarious financial situation. We believe in sustainable travel and part of that is being fair to the locals who make our trips unforgettable.

We hope that you find our policy reasonable.

1. The contract

A contract shall arise when the Company (Camino Confidence) has received its completed Booking Form together with a deposit or full payment for the tour.

2. Payment

To secure a Camino Confidence tour, the customer will pay a non-refundable deposit of 315 euros at the time of booking (this includes a bank processing fee of 15 euros).  Although this deposit is non-refundable, it is transferable to another Camino Confidence tour to be taken within the next 12 months depending on availability.

The final balance payment of your tour is due at least 170 days prior to the departure date. If the tour you select begins within 170 days of booking, final payment is due at that time.

3. cancellation Policy

UNFORESEEABLE EVENTS:

Our clients may receive a 100% refund of the Tour price even within 170 days of your Tour date if you are prevented from taking the Tour because of an unforeseeable event that is out of your control and shows up after the booking (“Unforeseeable Events”). The determination of what constitutes Unforeseeable Events is at the discretion of Camino Confidence.

The following is a list of examples of Camino Confidence consider as Unforeseeable Events: Impersonal events that make it dangerous or impossible to safely undertake a tour, such as travel bans or lockdowns imposed by the government where the tour takes place that prevent you from being able to enter the country or partake in the tour:

epidemic disease unusual to an area (excluding Covid)

  • war
  • civil insurrection
  • strike
  • earthquake
  • natural disaster

THE FOLLOWING EXAMPLES DO NOT CONSTITUTE UNFORESEEABLE EVENTS:

  •  Illness or injury of a tour participant
  •  Poor weather according to the season
  • Change of plans
  • Flight delays or cancellations
  • Being late to the tour or other booked services
  • Incorrect information such as hotel reservations or arrival dates.
  • Sending the wrong dates for the tour services

HOW TO CANCEL A TOUR:

 All Tour cancellations must be initiated by contacting Camino Confidence via email caminoconfidence@gmail.com 

OUR CANCELLATION FEES:

  • Cancellations received 90 days –to the first day of the tour 100% of the full tour price is payable.
  • Cancellations received 91 days – 120 days prior to the first day of the tour 75% of the full tour price is payable.
  • Cancellations received 121 – 150 days prior to trip start: 50% of the full tour price is payable.
  • Cancellations received 151 – 170  days prior to trip start: 25% € of the full tour price is payable.
  • No refunds will be issued due to late arrival / unused portion of a tour0

4. SUBSTITUTION

Where the customer is prevented from proceeding with the holiday, she may transfer her booking to someonewho satisfies all the conditions required by Camino Confidence, having first given the company reasonable notice in writing of her intention to do so before the departure date (such notice shall not be less than 21 days prior to the date of departure). The transferee of this customer must sign a Booking Form and comply with any other requirements of the Company applicable to the holiday such as the medical declaration. This will incur a 50 euros admin fee.

5. TOUR PARTICIPATION

You (The Customer) agree to accept the authority and decisions of the Company’s employees and representatives during the full duration of the holiday, starting at the first meeting on the first day and finishing at the last meeting point of the last day of the holiday.

If in the opinion of the Company’s employees and representations, the health, level of fitness or conduct of a Customer at any time before or after departure appears likely to endanger the safe, comfortable or happy progress of a holiday, endanger the safety or well-being of other Customers in her company, that of the Customer herself, or that of the Customer´s representatives, employees, contractors or agents.  Or if the Customer causes damage to any property belonging to anyone other than themselves, they may be excluded from all or part of the holiday immediately without refund or recompense.

In the case of ill-health, the company may make such arrangements as it sees fit and recover the costs thereof from the client.

If a customer commits an illegal act, the customer may be excluded from the holiday and the company shall cease to have a responsibility to/for them. If you are affected by a condition, medical or otherwise, that might affect you or other people’s enjoyment or active participation of the tour, you must advise us at the time of booking. No refund will be given for any unused services.

6. CANCELLATION BY THE COMPANY

The Company reserves this right to cancel a tour due to a lack of participants. The Customer will be repaid for the deposit or balance in full and this will constitute a full settlement, the Customer will not be at liberty to maintain a claim for compensation or otherwise for any loss arising as a consequence of the said cancellation of the trip.

Wherever possible you will be informed of cancellation before the balance is payable (170 days prior).

Camino Confidence cannot be held responsible for any losses such as the purchase of non-refundable airline tickets.

If, as a consequence of force majeure” The Company is obliged to cancel a holiday, the customer shall be repaid in full wherever possible (the Customer should be aware that some suppliers, such as carriers, impose cancellation fees and apply restrictions that are not within the control of the Company and for which the Company shall not be held liable.

 

NB. The term force majeure” means unusual and unforeseeable circumstances beyond the control of the Company, the consequence of which could not have been avoided even if all due care had been exercised or an event which the Company, the supplier of services even with all due care could not foresee or forestall, including:  Acts of God, Natural disasters, adverse weather conditions, fire or other destruction of any vessel, craft or vehicle to be used in connection with a holiday, riots, acts of war, civil commotion, the exercise of legislative, municipal, military or other authority strikes, industrial action, requisition of equipment, mechanical breakdown, shortage of fuel, insolvency or default of any carrier or service supplier connected with a holiday, fraud perpetrated against the Company or any other reason beyond the control of the Company

7. INSURANCE

Travel Medical Insurance is compulsory for all trips with Camino Confidence if you are traveling outside of your country or province of residence. You will be required to submit evidence of your travel medical insurance documents.

Travel Medical Insurance must include adequate coverage for:

Coverage for your transport to the nearest, appropriate medical facility in the event of injury. Where parts of our tours take place in remote locations, coverage should include helicopter evacuation/air ambulance, etc. and coverage for your medical repatriation to your home country for further treatment or returning your body home.

Cover emergency overseas medical treatment including treatment in a clinic or hospital, plus medicine as prescribed by your treating doctor to get you well and keep you travelling.

We recommend full medical insurance coverage that includes medical evacuation to your home.

8. COMPLAINTS

If the customer wishes to make a complaint in relation to a tour, she must immediately inform the Company’s representative (guide) at the location where the Customer is when the complaint arises and shall, if the Company requires it, send an email setting out the detail of this Customers complaint.

The customer shall be obliged to notify the Company in writing of any complaint not later than 28 days after her return to the point of departure or termination of the holiday whichever is the earlier. The email address is caminoconfidence@gmail.com

9. LUGGAGE TRANSFER

Where the booking includes luggage transfer, this includes 1 piece of luggage weighing no more than 20kg. A supplement applies for additional luggage pieces and overweight bags. Please inform us prior to your departure of any additional luggage or weight so that we can charge the appropriate fee and inform the service provider. 

An additional penalty of 30 euros per day and per bag is chargeable when the transporter informs us of extra weight or additional baggage. To avoid this penalty simply make us aware prior to departure so that we can calculate and apply the necessary changes.

A representative/ guide will provide you with a label, please ensure that it is attached securely to your bag.

Do not attach extra small bags to the main luggage to be transferred. The luggage transferrer and the Company will not take responsibility for such items.  If additional bags need to be transferred, you must notify us in advance so the appropriate charges can be applied, and the transporter advised of these additional bags to be collected. Failure to notify of extra bags to be transferred can result in these bags not being transferred and you would then be responsible for collecting the bag from the location where you left it. Bags must be left at reception by 8 am for collection.

10.LIMITATIONS OF CAMINO CONFIDENCES TOUR LIABILITY

Camino Confidence arranges trips with independent third parties, such as hotels, bus companies, tour operators, baggage handlers and other independent suppliers, to provide customers with the trip purchased. Camino Confidence exercises care in selecting these independent suppliers and pays particular attention to their reputation and reliability. However, Camino Confidence does not control these independent suppliers and cannot be held responsible for their performance or lack thereof.

Camino Confidence is not responsible for any injury, loss or damage whether mental, emotional or physical however sustained, resulting or arising from any error, omission or negligence of any company or person, its agents, employees or subcontractors supplying any trip.

Camino Confidence is not responsible for consequential damages or special damages suffered by customer, even in circumstances in which Camino Confidence is aware of the reason customer takes the trip, including circumstances in which customer arrives at a destination later than expected and/or is unable to attend an event/excursion, whether the event/excursion is included in the price of the Booking or not.

Customer shall have no claim against Camino Confidence by reason of customer failing to purchase any type travel insurance coverage.

11. PHOTOGRAPHY AND VIDEO

Tour suppliers have different policies about using photos, video and audio of tour participants in promotional materials and if customer does not want them to do so, customer must advise them not to do so in writing.

On trips photos, video and audio recordings may be taken/recorded and posted by participants and guides and customer grants Camino Confidence a perpetual, royalty-free, worldwide, irrevocable license to use all such images, recordings and postings in any fashion and for any purpose, including promotion, on its website and social media unless customer notifies Camino Confidence in writing that it may not do so.

12. WAIVER OF CLAIMS

The customer warrants that she is in sufficiently good health to undertake the activities purchased. The customer agrees to release Camino Confidence, its directors, employees, agents, representatives, collaborators, and independent contractors from and against all claims, actions, causes of action, costs, expenses and demands of any nature or kind whatsoever in respect to death, injury, loss or damage to him/her, wheresoever and howsoever caused arising out of, or in connection with my taking part in the Activity provided by Camino Confidence, or while traveling to and from the activity notwithstanding that the same may have been contributed to or occasioned by any act including, without limitation, negligence Camino Confidence and/or any one or more of its agents.

13.CHANGES TO THESE TERMS

Camino Confidence may make changes to these Terms from time to time, and all changes shall be binding on Customer from the date on which the change is brought to Customers attention.

14.PRIVACY

Camino Confidence will comply with the provisions of the Personal Information Protection and Electronic Documents Act and any other applicable privacy laws in its handling of private information. In particular Camino Confidence will:

  1. Protect personal information held by it.
  2. Identify the purpose of its collection and how it will be used.
  3. Use the information collected only for the stated purpose.
  4. Ensure that the information is accurate, complete and up to date.
  5. Protect the information against loss or theft.
  6. Report the theft of any information and notify the individual of all breaches where a “real risk of significant harm” to the individual is possible.

15.PRICE OF TOUR

All prices are for the tour only and do not include any transportation to or from the tour rendezvous or tour drop off. Or taxis or buses taken along the route.

All prices are for shared occupancy and single clients will be able to choose a roommate or be assigned a roommate by Camino Confidence.

All prices are subject to change, including the addition of surcharges, up to 170 days before the start date of the tour, but no such changes will occur once customer pays the full price of the tour.

Customers may choose to pay in any currency and customer will be responsible for any charges or fees over and above the price of the trip charged by their bank or credit card.

Camino Confidence is not responsible for any fees incurred due to currency exchange or fees charged by customers credit card/bank for processing funds in any currency.

Prices quoted by Camino Confidence for tours are based on information provided to it by tour suppliers, include applicable taxes and are subject to change according to trip supplier terms and conditions.

Camino Confidence will not increase the price of customers tour after customer has paid in full.

Camino Confidence reserve the right to impose surcharges up to 170 days before departure due to unfavorable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes or if government action should require us to do so. If any surcharge results in an increase of more than 7% of the trip price customer may cancel the booking within 14 days of notification of the surcharge and obtain a full refund.

16.OBLIGATIONS AND ACKNOWLEDGEMENTS OF CUSTOMER

Customer must review and verify all details set out on the Booking, all itineraries and invoices upon receipt from Camino Confidence, and Customer must immediately advise Camino Confidence of any errors or omissions.

Customer acknowledges having been directed by Camino Confidence to review these Terms and the details, terms and conditions of the trip on the Camino Confidence website booking page before making a booking.

Customer acknowledges the possibility of being required by Camino Confidence to sign additional documents, including Medical Questionnaires, Next of Kin, Waivers of Rights and additional terms and conditions, and being requested to provide additional information requested by Camino Confidence, in order to participate in a tour. Customer acknowledges the requirement by Camino Confidence to update Medical Questionnaires prior to departure.

Customer acknowledges that for all trips Customer must purchase medical travel insurance, that covers evacuation and repatriation coverage to their home, including personal injury and all forms of medical expense. Proof of insurance coverage for Customer is required.

Customer acknowledges that Camino Confidence has strongly recommended that customer purchase travel insurance coverage for trip cancellation (including COVID-19), trip interruption (including COVID-19) and property. Customer acknowledges that some countries will refuse entry if customer does not have proof of travel insurance.

Customer is responsible for ensuring possession of all necessary travel documentation, including passport (valid until six months after the expected return date), visas, required by any destination to which they are travelling or in which they will be in transit and pardons with respect to any criminal conviction.

Customer acknowledges that even with possession of the required documentation and information, Customer may be refused entry into another country at either the point of departure or arrival.

Customer acknowledges that the destination(s) to which they are traveling may have living standards and practices and conditions with respect to the provision of utilities, services and accommodation that are different from those enjoyed at home.

Customers shall be responsible for notifying Camino Confidence of any special requirements regarding the travel arrangements, including the type of accommodation required and dietary requirements of Customer, at the time of making the Booking. Camino Confidence will make trip suppliers aware of such requests and Customer shall be responsible for any additional costs for such requests; however, Camino Confidence shall not be responsible for any failure by the trip suppliers to provide such services.

Customer acknowledges that some tours take place far away from providers of medical care and that some trips may not be suitable for Customer based on physical or mental requirements for participation. Customer acknowledges responsibility for assessing whether a tour is suitable for Customer. Customer is responsible for consulting a medical professional to confirm fitness for travel and participation in any trip.

Customer acknowledges that permitted consumption of alcohol is tour-specific, based on many factors such as location, accommodation types, local supplier policies and activities and only when at fixed-roof accommodations or dining at local restaurants or licensed establishments.

Customer acknowledges that Customer may not be under the influence of alcohol or other intoxicant while participating in any outdoor aspect of a tour. Customer acknowledges that if a guide determines that Customer is not in the appropriate condition to participate in any activity, for any reason, the guide has the absolute right to prevent participation by Customer.

Customer acknowledges that use of illegal substances/drugs on a tour is not permitted and any such use will result in removal from the tour. No refund will be provided to Customer if a tour is not completed due to removal for this reason and any costs incurred by Customer due to such removal, including transportation, accommodation, meals, etc. will be the responsibility of customer.

Customer acknowledges that Camino Confidence encourages a non-smoking environment on all trips and customer will not smoke in the presence of other trip participants and only where permitted by local law.

If customer has a complaint, it must be reported to the trip leader or guide immediately so that Camino Confidence has the best chance of rectifying the problem. If customer is not satisfied with the response from the guide, customer must email Camino Confidence at caminoconfidence@gmail.com  so that Camino Confidence has the best chance of rectifying the problem.

Camino Confidence shall not be liable for any damage or loss suffered by customer, including the inability to use any aspect of the trip, as a result of failing to comply with any of the obligations in this section of the Terms.
